These Terms of Service ("Terms") govern your access to and use of the Area Kit Pro mobile application (the "App") and the website located at areakit.pro (the "Site"), operated by Byzantine Glam LLC ("we," "us," or "our").
By creating an account or using Area Kit Pro, you agree to be bound by these Terms. If you do not agree, do not use the App or Site.
Area Kit Pro is a pay-per-use service that generates neighborhood infographic guides for real estate professionals. You enter a U.S. ZIP code, choose a visual style, optionally add your agent branding, and receive a downloadable infographic (PNG and PDF) populated with publicly available neighborhood data.
You must be at least 18 years old and capable of forming a binding legal agreement to use Area Kit Pro. By using the App, you represent and warrant that you meet these requirements.
Area Kit Pro operates on a credit system. Each infographic guide costs one (1) credit to generate. Credits are purchased in advance through Apple In-App Purchase within the App.

Prices are in U.S. dollars and may vary by region based on Apple's pricing tiers. We reserve the right to change pricing at any time. Price changes will not affect credits already purchased.
All payments are processed by Apple through the App Store. By making a purchase, you agree to Apple's terms and conditions for In-App Purchases. We do not collect, store, or have access to your payment card information.
Because credits are consumed instantly upon guide generation, we generally do not offer refunds for used credits. However:

Infographics are populated with publicly available data from third-party sources, including the U.S. Census Bureau, Walk Score, the National Center for Education Statistics (NCES), LocationIQ, and Mapbox. We do not independently verify this data.
While we strive to present accurate, up-to-date information, we make no representations or warranties regarding the accuracy, completeness, or timeliness of any data displayed in generated infographics. Specifically:
Infographics generated by Area Kit Pro are informational marketing materials only. They do not constitute real estate appraisals, financial advice, legal advice, or official government data reports. You should independently verify any data before relying on it for business or financial decisions.
You are solely responsible for how you use and distribute generated infographics. You are responsible for ensuring that any agent branding information you include is accurate and that your use of the infographics complies with applicable real estate advertising laws and regulations in your jurisdiction (including MLS rules, state licensing board requirements, and fair housing laws).
The App, Site, templates, design elements, code, and all related materials are owned by Byzantine Glam LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.
You retain ownership of any branding information and content you provide (agent name, logo, contact details). By providing this content, you grant us a limited, non-exclusive license to include it in your generated infographics.
Once generated, you receive a non-exclusive, perpetual, royalty-free license to use, reproduce, and distribute your infographic guides for your personal and professional purposes. You may not claim the Area Kit Pro template designs as your own original work or remove any attribution if included.
Area Kit Pro relies on third-party services including Apple (App Store and payments), Supabase (database and authentication), and various data APIs. We are not responsible for the availability, accuracy, or performance of these third-party services. Their use is governed by their own respective terms and privacy policies.
We strive to keep the App available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

THE APP AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the App will be error-free, uninterrupted, secure, or free from viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any data in generated infographics.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYZANTINE GLAM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER ARISING FROM CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Byzantine Glam LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.
Before filing any formal dispute, you agree to contact us at support@areakit.pro and attempt to resolve the dispute informally for at least thirty (30) days.
If a dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify you via email or in-app notification at least 14 days before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App and may request account deletion.
